Acceptance of Terms
By downloading, installing, or using the mobile application Boop (the “App”) by IS Apps, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the App.
License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms. All rights not expressly granted are reserved by IS Apps.
Prohibited Activities
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from the App.
- Bypass or interfere with security, access controls, rate limits, or integrity of the App.
- Use automated tools (bots, scrapers, crawlers) except where expressly permitted.
- Introduce malware, exploit bugs, or disrupt the App or networks.
- Sell, lease, sublicense, or commercially exploit the App without written permission.
User Content
Ownership
You retain ownership of any content you create, upload, submit, or share via the App ("User Content").
License to IS Apps
By submitting User Content, you grant IS Apps a worldwide, non-exclusive, royalty-free, sublicensable, transferable, perpetual, and irrevocable license to use, host, store, reproduce, distribute, transmit, display, perform, adapt, modify, translate, create derivative works from, and otherwise exploit such User Content in connection with operating, improving, and marketing the App and related services, websites, and promotional materials.
Representations & Warranties
- You have all necessary rights to submit the User Content and grant the license above.
- Your User Content does not infringe any third-party rights (including copyright, trademark, privacy, or publicity rights), is not illegal, defamatory, hateful, harassing, sexually explicit/exploitative, or otherwise harmful.
- Your User Content complies with these Terms and all applicable laws.
Moderation & Removal
We may, at our sole discretion and without obligation, review, remove, or restrict access to any User Content at any time, including for violations of these Terms or applicable laws.
Copyright Complaints
If you believe material in the App infringes your copyright, notify us at admin@isapps.app with: (a) a description of the copyrighted work and the allegedly infringing material; (b) your contact details; (c) a statement that you have a good-faith belief the use is not authorized; and (d) a statement under penalty of perjury that your notice is accurate and you are the rights holder or authorized to act on their behalf.
Virtual Items and Currency
The App may include virtual items or currency. These are licensed, not sold, to you. We reserve the right to manage, regulate, or modify virtual items and currency at our discretion.
Updates and Modifications
We may update the App or these Terms at any time. If changes are material, we will provide notice (e.g., in-app notice or email). Continued use of the App after changes become effective constitutes acceptance of the updated Terms.
Termination
We may suspend or terminate your access to the App at any time, with or without notice or liability, including for violations of these Terms. Upon termination, your license to use the App ends immediately.
Intellectual Property
Except for User Content, the App and all materials therein (software, designs, graphics, logos, trademarks, etc.) are owned by IS Apps or its licensors and are protected by intellectual property laws. You may submit feedback or suggestions; we may use them without restriction or obligation.
Disclaimer of Warranties
THE APPS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APPS WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IS Apps SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO USE THE APPS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify and hold harmless IS Apps, its affiliates, and personnel from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the App, or your violation of these Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of Israel, without regard to its conflict-of-law principles. You agree to the exclusive jurisdiction of the competent courts located in Tel Aviv–Yafo, Israel, for any disputes arising out of or relating to these Terms or the App, except where applicable law in your country of residence provides mandatory rights to bring claims locally.
Miscellaneous
- Severability: If any provision is held invalid, the remainder remains in effect.
- Entire Agreement: These Terms constitute the entire agreement between you and IS Apps regarding the App and supersede prior agreements.
- No Waiver: Our failure to enforce any right is not a waiver.
- Assignment: You may not assign these Terms; we may assign them as part of a merger, acquisition, or sale of assets.
